These Terms of Service ("Terms") govern your access to and use of Pernovora ("Service"), operated by Pernovora at pernovora.com. By using the Service, you agree to these Terms.

1. The Service

Pernovora provides an AI-powered reply assistant and related creator tools, including credit-based API usage for generating replies and managing workflows across supported platforms.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using Pernovora, you represent that you meet these requirements.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

4. Credits and Payments

The Service may be offered through prepaid credit packs. Credits are consumed when you use AI features and related tools. Prices and pack details are listed on the Pricing page and may change. Credits are non-transferable unless we state otherwise.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes
• Attempt to reverse engineer, disrupt, or overload the Service
• Circumvent usage limits, credit metering, or security controls
• Submit content that infringes intellectual property or privacy rights of others
• Use outputs in ways that violate platform rules of third-party services you connect
• Misrepresent AI-generated content as human-authored where disclosure is required by law or platform policy

6. Your Content

You retain ownership of content you submit. You grant us a limited license to process that content solely to provide and improve the Service. You are responsible for the legality of content you submit and how you use generated outputs.

7. Intellectual Property

The Service, including software, branding, and documentation, is owned by Pernovora and its licensors. These Terms do not grant you ownership rights in the Service.

8. Refund Policy

Because credits can be consumed immediately through API usage, purchases are generally non-refundable once credits have been delivered to your account. If you experience a billing error, duplicate charge, or unused credits due to a verified service outage caused by us, contact support@pernovora.com within 14 days of purchase. Refund eligibility is determined at our reasonable discretion.

9. Third-Party Services

The Service may integrate with or rely on third-party platforms and AI providers. Your use of those services is subject to their own terms. We are not responsible for third-party outages, policy changes, or account actions on platforms you use.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR SPECIFIC USE CASE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERNOVORA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Pernovora from claims arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate access if you violate these Terms or misuse the Service. You may stop using the Service at any time. Provisions that by nature should survive termination will survive.

14. Changes

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
